Terms of Service
These Terms of Service ("Terms") govern your use of Portarus, the AI security gateway platform operated by Cogmus (trading as Portarus). By accessing, registering, or using our Services, you agree to be legally bound by these Terms in their entirety. If you do not agree with any provision herein, you must immediately discontinue use of the platform.
1. Definitions and Interpretations
"Service" or "Services": The AI gateway application, security filters, webhook processing system, dashboard, API, and all related features accessible via https://portarus.com or portarus.com.
"User" or "You": Any natural or legal person who registers, logs in, or operates an account on the platform, whether acting on behalf of themselves or an organization.
"Account": Your registered profile, credentials, API keys, projects, gateways, and all associated configuration within the Service.
"Content": Any prompts, payloads, requests, configurations, metadata, logs, or data transmitted through your Account or the gateways.
"Webhook Endpoint": The custom URL endpoint configured by you to receive filtered and analyzed requests from Portarus.
"Intellectual Property": All patents, copyrights, trademarks, trade secrets, algorithms, and know-how related to the Service and its operation, owned exclusively by Cogmus.
"Force Majeure Event": Any unforeseeable, extraordinary circumstance beyond reasonable control, including but not limited to natural disasters, wars, pandemics, government actions, or large-scale infrastructure failures.
2. Acceptance of Terms and Modifications
Your acceptance of these Terms occurs at the moment you click "I agree," complete account registration, or first transmit data through the Service. These Terms apply to all Users, including those using free trial tiers, and supersede any prior agreements or understandings.
Cogmus reserves the unconditional right to modify these Terms at any time. Substantial changes will be announced via email to your registered address or prominent notification on the platform. Continued use of the Service after such notice constitutes irrevocable acceptance of the modified Terms. If you reject modifications, you must cease using the Service and delete your Account.
Failure or delay in enforcing any provision does not constitute a waiver of that provision or any other right. The waiver of any breach does not constitute a waiver of any subsequent breach.
3. Account Registration and Credentials
You represent and warrant that all information provided during registration is accurate, current, and complete. You are solely responsible for maintaining the strict confidentiality of your password, API keys, and any other authentication credentials. You agree to immediately notify [email protected] of any unauthorized access or breach of security.
You bear full responsibility and liability for all activities conducted using your Account credentials, regardless of whether such activities were authorized by you. Cogmus is not liable for unauthorized use of credentials that you failed to protect adequately. You agree to terminate your session and log out when using shared or public devices.
Cogmus reserves the right to suspend or terminate Accounts that appear dormant, fraudulent, or in violation of these Terms without prior notice. Account holders must be at least 13 years old, or 18 years old for commercial enterprise accounts and payment processing.
4. Service Description and Scope
Portarus is a semantic security gateway designed to intercept, analyze, and filter webhook requests before they reach your target endpoints. The Service employs multiple layers of protection: rate limiting, deduplication, token analysis, and artificial intelligence-driven semantic threat detection.
The Service operates by receiving incoming requests at a Portarus-hosted endpoint (portarus.com), applying configurable security rules and filters, and forwarding approved traffic to your specified Webhook Endpoint. All traffic flows are logged, timestamped, and stored according to your subscription tier. No modifications are made to successful payloads unless explicitly configured by the User.
Cogmus does not monitor, analyze, or retain the content of payloads forwarded to your Webhook Endpoint after validation. The Company does not execute the payloads, render decisions based on them, or take independent action based on their contents. You remain solely responsible for how you process, store, and respond to filtered requests.
5. User Obligations and Permitted Uses
You agree to use the Service solely for its intended purpose: protecting AI systems and web applications from semantic attacks, cost anomalies, and policy violations. You may not:
- Attempt to reverse-engineer, decompile, or discover the algorithms underlying the semantic analysis engine.
- Use the Service to attack, test, or probe third-party systems or infrastructure without explicit authorization.
- Engage in mass-scale automated requests, flood attacks, or distributed denial-of-service (DDoS) activities targeting Portarus infrastructure.
- Attempt to forge, manipulate, or bypass HMAC signatures, timestamps, or authentication headers.
- Exploit rate limits, quotas, or trial periods to circumvent paid plan requirements.
- Resell, sublicense, or redistribute access to the Service without written agreement.
- Use the Service to generate, store, or transmit content that is illegal, defamatory, obscene, or infringes third-party intellectual property rights.
- Conduct unauthorized security testing or penetration testing against the Service without prior written consent.
Violations of these restrictions will result in immediate Account suspension, permanent termination, and potential legal action. Cogmus reserves the right to block IP addresses, revoke API keys, and report abusive behavior to relevant law enforcement agencies.
6. Fees, Billing, and Payment
Cogmus offers tiered subscription plans with varying quotas, retention periods, and feature sets. All fees are exclusive of applicable taxes unless explicitly stated otherwise. You are responsible for paying all applicable governmental taxes and duties.
Billing occurs automatically on the date specified in your Account settings each month, quarter, or year as selected. You authorize Cogmus to charge your designated payment method. Failed payments may result in service suspension after a grace period of five (5) business days. Continued non-payment will trigger Account termination and potential debt collection proceedings.
Refund requests must be submitted in writing within fourteen (14) days of charge. Cogmus reserves the right to deny refunds for Services already rendered. Downgrades take effect at the start of the next billing cycle. Cancellations require thirty (30) days' notice and must be submitted via the Account control panel.
All fees are payable in United States Dollars (USD). Cogmus reserves the right to adjust pricing with thirty (30) days' prior written notice. Price increases take effect at the start of your next billing period.
7. Service Level Agreement and Uptime Commitment
Cogmus commits to maintaining an uptime target of 99.9% for the Service infrastructure. This target is measured over rolling thirty-day periods and excludes scheduled maintenance windows announced with at least seventy-two (72) hours' notice.
Uptime excludes unavailability caused by: Force Majeure Events, User misconfiguration, third-party service failures (including but not limited to database, CDN, or payment processor outages), large-scale DDoS attacks targeting the internet backbone, governmental actions or restrictions, or issues with your Webhook Endpoint or network connectivity.
Critical incidents receive response within 24 hours. Non-critical incidents are addressed within two (2) business days. Response does not guarantee resolution. Service credits may be available for qualifying outages exceeding the defined SLA; details are available upon request and apply only to fees paid in the preceding month.
The SLA represents the full extent of Cogmus's liability for service availability. No other remedies, including specific performance orders or injunctive relief, are available.
8. Data, Privacy, and Retention
All logs, request metadata, and filtered payloads are encrypted in transit using TLS 1.3 and at rest using AES-256-bit AES encryption. Logs are retained according to your subscription tier and deleted automatically upon expiration. Data subjects may request deletion via formal Data Subject Access Requests submitted to [email protected].
Cogmus acts as a data processor under applicable data protection laws. You retain ownership of your Content. We process Content only as directed by you and in accordance with written Data Processing Agreements. Backups are retained for disaster recovery purposes for up to twelve (12) months and are subject to the same confidentiality protections as live data.
Personal data, including email addresses, API keys, and audit logs, may be retained longer than Content logs for billing, legal, and compliance purposes. You have the right to request access, correction, or deletion of personal data by submitting a verified request to our Data Protection Officer.

9. Third-Party Services and Subprocessors
Portarus relies on trusted third-party providers to deliver global infrastructure, reliability, and performance. These subprocessors include:
- Cloudflare, Inc.: Infrastructure, CDN, Edge Computing (Region: USA)
- Stripe, Inc.: Payment Processing (Region: USA)
- Supabase: Database Services (PostgreSQL) (Region: USA)
- Upstash, Inc.: Redis Cache Services (Region: USA)
Cogmus carefully selects and audits all subprocessors to ensure data protection standards. You may object to the use of new subprocessors by submitting written objections within ten (10) business days of notification. Substantive objections may be cause for service discontinuation at user request without early termination penalties.
Cogmus is not responsible for the practices or policies of third-party providers beyond ensuring contractual compliance with data protection requirements. However, Cogmus remains liable to you for the performance of its subprocessors.
10. Limitation of Liability and Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Cogmus DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.
LIMITATION OF DAMAGES: Except for breaches of confidentiality or indemnification obligations, neither party's total cumulative liability arising out of or related to these Terms shall not exceed the fees paid by User in the twelve (12) months preceding the claim. This cap applies equally to direct, indirect, incidental, consequential, special, and punitive damages.
EXCLUDED DAMAGES: In no event shall Cogmus be liable for lost profits, lost opportunity, lost data, business interruption, reputational harm, cost of substitute services, or any indirect or consequential damages, even if Cogmus has been advised of the possibility of such damages.
FALSE POSITIVES AND NEGATIVES: The semantic analysis engine is not infallible. Cogmus does not guarantee that the Service will detect all threats, prevent all attacks, or avoid false positives that block legitimate traffic. You acknowledge that no security tool is 100% effective and that you remain responsible for independent security measures.
WEBHOOK ENDPOINT RESPONSIBILITY: Cogmus is not responsible for the availability, performance, or security of your Webhook Endpoint. If your endpoint is compromised, misconfigured, or unavailable, Cogmus has no obligation to re-send filtered payloads or compensate for lost data.
11. Indemnification
You agree to indemnify, defend, and hold harmless Cogmus and its officers, employees, agents, and successors from any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your violation of these Terms or applicable law.
- Your misuse of the Service or User Content you transmit through the Service.
- Your infringement of third-party intellectual property rights.
- Your configuration of Webhook Endpoints or downstream handling of filtered data.
- Claims by third parties against you that indirectly impact Cogmus.
Cogmus must provide prompt written notice of such claims and cooperate reasonably in your defense. You shall not settle any claim without Cogmus's prior written consent.
12. Suspension and Termination
Cogmus may suspend or terminate your Account and access to the Service immediately without notice if:
- You violate these Terms or the Acceptable Use Policy.
- You engage in illegal, fraudulent, or threatening activity.
- You fail to pay invoices within the grace period.
- We receive legal process requiring cessation of service (court orders, government requests).
- We determine, in our sole discretion, that your Account poses a technical or security risk to the platform.
Upon termination, your Account will be locked, and we will delete your data according to our retention schedule—typically within thirty (30) days unless legal holds apply. Any outstanding payment obligations survive termination. You may request your logs in compliance with applicable law before final deletion, subject to a reasonable administrative fee.
Termination for cause voids any outstanding service credits and prohibits refunds. Voluntary termination by you takes effect at the end of the current billing cycle unless you request immediate deletion (in which case no refund is issued).
13. Intellectual Property and Ownership
All intellectual property in the Service, including algorithms, UI/UX design, documentation, and brand elements, remains the exclusive property of Cogmus and its licensors. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service solely to access and benefit from its features as authorized.
You retain ownership of your User Content but grant Cogmus a worldwide, royalty-free license to process, store, and analyze your Content solely to provide and improve the Service. This license survives termination for up to thirty (30) days for backup and legal compliance purposes.
You do not acquire any right to remove or obscure Cogmus's proprietary notices, trademarks, or copyrights. Any unauthorized copying, modification, or redistribution of the Service constitutes copyright infringement and will result in immediate legal action.
14. Security and Incident Response
Cogmus implements industry-standard security controls including encryption, access controls, regular security audits, and penetration testing. However, no system is immune to attack, and Cogmus cannot guarantee absolute security.
In the event of a confirmed security incident affecting your Account or Data, Cogmus will notify you without unreasonable delay via email. You waive any claim that notification was insufficient if you received email at the address registered in your Account. Notification does not imply Cogmus liability beyond providing the notice itself.
You are responsible for implementing additional security measures at your Webhook Endpoint, including IP whitelisting, rate limiting on your side, and encryption of sensitive data in transit.
15. Dispute Resolution and Governing Law
These Terms shall be governed by and construed in accordance with the laws of State of Delaware, United States, without regard to its conflicts of law principles. You irrevocably consent to the exclusive jurisdiction of state and federal courts located within Wilmington, Delaware.
ARBITRATION CLAUSE (BINDING): By accepting these Terms, you and Cogmus agree to resolve all disputes exclusively through binding arbitration administered by Commercial Arbitration Rules, except for claims seeking injunctive relief or involving intellectual property infringement.
Arbitration will be conducted on an individual basis, not as a class action, collective action, or representative action. You waive your right to jury trial and your right to appeal arbitration awards (except as permitted by law). Each party bears its own attorneys' fees unless applicable law or arbitration rules provide otherwise.
Informal resolution: Before initiating arbitration or legal proceedings, either party may submit a written demand for informal resolution to [email protected]. The parties agree to negotiate in good faith for thirty (30) days. Failure to reach resolution permits escalation to formal proceedings.
16. Force Majeure
Cogmus shall not be liable for any failure or delay in performance under these Terms caused by circumstances beyond reasonable control, including natural disasters, war, terrorism, pandemics, governmental actions, internet backbone failures, or major power outages.
In the event of a Force Majeure Event, Cogmus will make reasonable efforts to resume services and notify affected Users. However, extended outages (exceeding seven days) may justify termination without the standard cancellation procedures or early termination penalties.
17. Compliance and Legal Notices
Cogmus complies with applicable data protection laws including GDPR and CCPA. All legal and privacy inquiries should be directed to [email protected]. Abuse reports may be submitted to [email protected].
Any legal documents, subpoenas, or government requests must be served according to our registered agent procedures. Users must not direct legal process to unofficial addresses.
These Terms constitute the entire agreement between you and Cogmus regarding the Service and supersede all prior negotiations, proposals, agreements, and understandings. If any provision is found invalid or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable while preserving the parties' intent. All other provisions remain in full force.
